Barry West has been involved in all aspects of complex business, real estate, first amendment, attorney malpractice, sports and entertainment litigation for more than 40 years. Barry was selected as a finalist for the 2000 Trial Lawyer of the Year award by the Trial Lawyers for Public Justice division of the American Bar Association. He has repeatedly been named a Southern California "Super Lawyer of the Year."

Barry graduated second in his class from St. John's University School of Law in New York where he was an editor of the Law Review with two published articles. Barry has a Masters of Law degree from Harvard Law School. After litigating for a major New York City law firm, Barry moved to Los Angeles to become vice-president and general counsel of Technicolor, Inc. He returned to private practice when he became a litigation partner at a well-known Los Angeles law firm. Barry regularly has been selected to preside as an arbitrator in cases referred by the Los Angeles Superior Court. He serves on the boards of and holds leadership positions in a variety of community and charitable organizations.

Representative Areas of Practice:

Business Litigation:
For more than 40 years Barry has represented business entities and individuals in all aspects of complex business litigation. Barry was lead defense counsel in a three-month jury trial. The plaintiffs, two former major stockholders of the on-line ticketing company, Tickets.com, had brought a variety of claims against the Firm's clients, a major venture capital firm and one of its managing members, seeking 149 million dollars in damages. The jury returned a verdict in favor of the Firm's clients, ruling against plaintiffs on both liability and damages. The jury verdict was affirmed on appeal.

Entertainment:
Barry frequently represents both plaintiffs and defendants in high profile entertainment disputes. Barry was lead defense counsel for a major Hollywood studio defending an action brought by the producer-creator of a long-running television series who sought more than 20 million dollars in allegedly unpaid profit participations. After a three-week jury trial the jury returned a complete defense verdict in favor of the Firm's client. The jury verdict was affirmed on appeal.

In another entertainment litigation matter Barry successfully represented a major motion picture company against a foreign film distributor in an American Film Marketing Association arbitration. Barry's client was awarded and collected a significant verdict.

Sports:
Barry has represented several well-known sports figures in litigation matters relating to contracts, licensing, misuse of name and likeness, and breach of fiduciary duties.

Advertising:
Barry has been retained to represent several major advertising agencies in lawsuits and arbitrations. Barry obtained an arbitration award on behalf of the Firm's client, a prominent advertising agency, against a major toy company that had commissioned but then refused to pay for a television commercial.

Legal Malpractice:
Barry has successfully defended several major law firms accused of professional malpractice. He has also successfully prosecuted professional malpractice claims on behalf of clients against well-known law firms.

Real Estate:
Barry has represented clients in a variety of real estate disputes including partnership disputes and dissolutions, construction defects and commission claims.

Defamation and First Amendment:
Barry has successfully represented both media and individuals as plaintiffs and defendants in several high-profile cases involving alleged product disparagement, libel, slander and false advertising.

Employment Litigation:
Barry successfully defended employers in a variety of cases, including claims for breach of employment contract, wrongful termination and the like.

International Litigation:
Barry has been involved in disputes involving foreign entities including Swiss banks, Hong Kong manufacturers and Canadian franchisors.
